1. Introduction
These Terms and Conditions (the "Terms") govern the Wirex Giveaway (the "Promotion"), offered by Wirex Europe sp z.o.o. except for all customers based outside of the European Economic Area, where the giveaway will be offered by Wirex Australia PTY Ltd (each separately referred to as "Wirex").
The Promotion is NOT available to Wirex users residing in the following jurisdictions; the UK, the USA and Singapore.
2. Definitions
"APAC" means Hong Kong, Taiwan, Australia, and Thailand.
"EEA" means the European Economic Area, a free-trade zone composed of the states of the European Union together with Iceland, Norway, and Liechtenstein.
“Eligible Participants” refers to individuals who are Wirex users and meet the requirements outlined in the Eligibility section of this Agreement.
"Giveaway Announcement" means the communication published by Wirex setting out the specific details of the Promotion, including the Promotion name, Promotion Period, eligibility requirements, entry requirements, Reward, number of Winners, eligible and excluded jurisdictions, and the relevant Wirex entity organising the Promotion.
"Promotion" means the giveaway, competition or promotional campaign described in the applicable Giveaway Announcement and governed by these Terms.
"Promotion Period" means the period during which entries to the Promotion will be accepted, as specified in the Giveaway Announcement.
"Reward" means the prize, benefit or other reward offered as part of the Promotion, as described in the Giveaway Announcement.
"Winner" means an Eligible Participant who has been selected by Wirex to receive a Reward in accordance with these Terms and the Giveaway Announcement.
"Working Day" means a day other than a Saturday, Sunday or public holiday in the jurisdiction of the relevant Wirex entity organising the Promotion.
3. Promotion Period
The Promotion will commence and end on the dates specified in the Giveaway Announcement.
Entries received outside the Promotion Period will not be considered.
4. Eligibility
Unless otherwise stated in the Giveaway Announcement, participants must:
be at least 18 years old;
have legal capacity to enter into binding agreements;
reside in an eligible jurisdiction;
hold a fully verified Wirex account where required;
comply with all applicable laws and regulations.
The Promotion is void where prohibited by law.
Wirex may exclude residents of certain jurisdictions where participation would breach applicable laws or regulatory requirements.
Employees, contractors, consultants, agents and immediate family members of Wirex or any company involved in administering the Promotion may be excluded where required.
Wirex reserves the right to request proof of identity, residence, eligibility and compliance before awarding any Reward.
5. How to Enter
Participants must complete the entry requirements described in the Giveaway Announcement.
Unless expressly stated otherwise:
only one entry per person is permitted;
automated entries are prohibited;
entries submitted using bots, scripts or similar technology are invalid;
entries submitted using multiple accounts or false identities may be disqualified.
Participants may withdraw from the Promotion before the closing date by contacting Wirex Support.
6. Winner Selection
Unless otherwise stated:
Winners will be selected fairly from all eligible entries.
Where random selection is specified, Winners will be selected using an appropriate random selection process.
Where skill-based selection applies, entries will be assessed using the criteria described in the Giveaway Announcement.
Wirex's decision is final except where prohibited by applicable law.
7. Rewards
The Reward will be described in the Giveaway Announcement.
Rewards will be awarded only to verified Winners who satisfy these Terms.
Rewards will be credited or delivered using the method specified in the Giveaway Announcement.
Where a Reward consists of a digital asset, fiat currency or other transferable asset, the Winner may use, hold, transfer or exchange the Reward in accordance with the applicable Wirex Terms and Conditions.
Wirex reserves the right to substitute a Reward with another reward of equal or greater value where this is reasonably necessary due to circumstances beyond its control or where the advertised Reward becomes unavailable.
Any taxes or other charges arising from receipt or use of a Reward are the sole responsibility of the Winner.
8. Reward Distribution
Wirex will notify Winners using the communication method specified in the Giveaway Announcement.
If:
the Winner cannot be contacted;
fails to respond within the required timeframe;
fails verification;
breaches these Terms; or
is otherwise ineligible,
Wirex may select an alternative Winner.
Rewards will be distributed within the timeframe specified in the Giveaway Announcement.
9. Verification
Before awarding any Reward, Wirex may require the Winner to provide information necessary to verify:
identity;
age;
residency;
eligibility;
ownership of the relevant Wirex account;
compliance with these Terms.
Failure to provide satisfactory information may result in disqualification.
10. Disqualification
Wirex reserves the right to disqualify any participant who:
provides false or misleading information;
manipulates or attempts to manipulate the Promotion;
uses bots or automated methods;
creates multiple accounts;
breaches these Terms;
breaches applicable law;
acts fraudulently;
attempts to interfere with the fair operation of the Promotion.
Wirex may cancel or reclaim any Reward awarded in error or obtained through fraud.
11. Publicity
Where permitted by applicable law, Winners agree that Wirex may publish:
first name;
social media username;
country of residence;
likeness,
for reasonable promotional purposes relating to the Promotion without additional compensation.
Where local law requires consent, Wirex will obtain it separately.
12. Privacy
Personal data collected in connection with the Promotion will be processed in accordance with:
Wirex's Privacy Policy;
applicable data protection legislation.
Data will be processed only for administering the Promotion, verifying eligibility, awarding Rewards and complying with legal obligations.
13. Suspension, Modification or Cancellation
Wirex reserves the right to:
amend these Terms;
suspend;
modify; or
cancel the Promotion,
where reasonably necessary, including where:
fraud is suspected;
technical failures occur;
legal or regulatory changes require amendment;
circumstances arise outside Wirex's reasonable control.
14. Limitation of Liability
To the fullest extent permitted by law, Wirex accepts no liability for:
lost or delayed entries;
technical failures;
internet or platform outages;
incorrect contact details supplied by participants;
failure to receive notifications;
fluctuations in the value of digital assets;
indirect or consequential losses.
Nothing in these Terms excludes liability that cannot legally be excluded.
15. Force Majeure
Wirex shall not be liable for failure to perform its obligations where caused by events beyond its reasonable control, including:
natural disasters;
governmental action;
war;
civil unrest;
epidemics or pandemics;
cyber incidents;
telecommunications failures;
failures of third-party platforms.
16. Compliance With Laws
Participants are responsible for ensuring that participation is lawful in their jurisdiction.
Wirex may refuse entry where participation would breach applicable sanctions, anti-money laundering laws or other legal or regulatory requirements.
17. Governing Law
Where the Promotion is organised by:
Wirex Europe sp. z o.o., these Terms shall be governed by the laws of Poland and subject to the exclusive jurisdiction of the Polish courts.
Wirex Australia Pty Ltd, these Terms shall be governed by the laws of Victoria, Australia and subject to the exclusive jurisdiction of the courts of Victoria.
Where another Wirex entity organises the Promotion, the applicable governing law and jurisdiction will be specified in the Giveaway Announcement.
18. General
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Failure by Wirex to enforce any provision shall not constitute a waiver of that provision.
These Terms, together with the Giveaway Announcement, constitute the entire agreement between Wirex and participants regarding the Promotion.
